Paid Family Leave benefits typically run concurrently with any federal FMLA leave that also qualifies — PFL pays you, FMLA protects your job. Check your FMLA eligibility →

How This Works With FMLA

Federal FMLA protects your job during qualifying leave but pays nothing. New York Paid Family Leave is a separate state benefit that pays part of your wages during that same period. When a leave qualifies under both, they typically run concurrently — FMLA protects your position while NY PFL replaces part of your paycheck.

Frequently Asked Questions

Unlike some states, New York doesn't run PFL through a single state agency. It's overseen by the NY Workers' Compensation Board, but claims are actually processed by your employer's disability/PFL insurance carrier (a private insurer or the State Insurance Fund, NYSIF) — check your paystub or HR department for which carrier covers you.

NY PFL pays 67% of your average weekly wage, up to a maximum of $1,229 per week, for up to 12 weeks. It's funded entirely through employee payroll contributions.

File with your employer's PFL insurance carrier, not a single central state website — paidfamilyleave.ny.gov has the required claim forms and a tool to help identify your employer's carrier if you don't already know it.
